1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the RecentFollow website at recentfollow.app and the RecentFollow mobile application (collectively, the "Service"), operated by RecentFollow.App ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are between 13 and 18 years of age, you may only use the Service with the consent of a parent or legal guardian. By using the Service, you represent and warrant that you meet these eligibility requirements.

3. Description of Service

RecentFollow is an Instagram follower tracking tool that allows users to view publicly available follower and following data for public Instagram accounts. The Service displays recent follow activity, follower lists, and demographic breakdowns based on publicly accessible information. The Service is available as a web-based tool and as a mobile application on iOS and Android.

4. User Responsibility

You agree to use the Service only for lawful purposes and in accordance with these Terms. Specifically, you agree not to:

• Use the Service to harass, stalk, intimidate, or threaten any person.
• Use the Service to engage in any activity that violates applicable laws or regulations.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Use automated tools, bots, or scripts to access the Service in a manner that exceeds reasonable personal use.
• Circumvent or attempt to circumvent rate limits, access controls, or other technical measures.
• Resell, redistribute, or commercially exploit the Service or data obtained through it without our written permission.
• Misrepresent your identity or affiliation when using the Service.

5. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to modify, copy, distribute, or create derivative works based on the Service or its content. All rights not expressly granted are reserved by RecentFollow.App.

6. Accounts and Access

The web-based tool does not require account creation. The mobile application may require you to create an account or sign in through Apple or Google. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@recentfollow.app if you suspect unauthorized use of your account.

7. Subscriptions and Payments

Certain features of the Service may require a paid subscription. Subscriptions are processed and managed through the Apple App Store (for iOS) or Google Play Store (for Android). By purchasing a subscription, you agree to the payment terms presented at the time of purchase, including pricing, billing frequency, and renewal terms.

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage or cancel your subscription through your Apple App Store or Google Play Store account settings.
• Prices may change from time to time. Any price changes will apply to the next billing cycle after notice is provided.

8. Refunds

All subscription purchases are processed through the Apple App Store or Google Play Store. Refund requests must be directed to the respective platform in accordance with their refund policies. RecentFollow.App does not directly process payments and cannot issue refunds for app store purchases. If you experience a technical issue that prevents you from using a paid feature, contact us at support@recentfollow.app and we will assist you.

9. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

10. Platform Dependency

RecentFollow is an independent tool and is not affiliated with, endorsed by, or connected to Instagram, Meta Platforms, Inc., Apple Inc., or Google LLC. The Service relies on publicly available data from Instagram. Changes to Instagram's platform, policies, or data availability may affect the functionality of our Service without prior notice. We do not guarantee uninterrupted access to Instagram data.

11. Intellectual Property

All content, features, and functionality of the Service, including but not limited to text, graphics, logos, icons, software, and design elements, are owned by RecentFollow.App and are protected by applicable intellectual property laws. The RecentFollow name, logo, and branding are trademarks of RecentFollow.App. You may not use our trademarks without prior written permission.

12. Disclaimers

The Service is provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free.
• The results obtained through the Service will be accurate or reliable.
• Any defects in the Service will be corrected.

Instagram may change its data availability or access methods at any time, which may affect the Service's functionality. We are not responsible for any actions taken by Instagram or Meta Platforms that impact our ability to provide the Service.

13. Limitation of Liability

To the maximum extent permitted by applicable law, RecentFollow.App, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or in connection with your use of the Service, whether based on warranty, contract, tort (including negligence), or any other legal theory, even if we have been advised of the possibility of such damages.

Our total aggregate liability for all claims arising out of or relating to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, or fifty euros (EUR 50), whichever is greater.

14. Indemnification

You agree to indemnify, defend, and hold harmless RecentFollow.App and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any third-party rights.

15. Termination

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms, abusive or excessive use patterns, or requests from law enforcement. Upon termination, your right to use the Service ceases immediately. Provisions of these Terms that by their nature should survive termination will remain in effect.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Romania. If you are a consumer in the European Union, you may also be entitled to invoke the mandatory consumer protection laws of your country of residence.

17. Changes to Terms

We may modify these Terms at any time. When we make changes, we will update the "Effective date" at the top of this page and, where appropriate, notify users through the Service or via email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you should stop using the Service.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RecentFollow.App regarding the use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
